You seem to be missing the point here. Whether for the right or wrong reasons, the aircraft was seized by the government for importation irregularities. Then, they had to decide what to do with it after it had been seized. Since it is a historic naval aircraft, it went to the NMNA. They could have ordered it destroyed, so the fact that it was passed to another government organisation that will ensure its preservation is probably the best outcome that could be hoped for in the circumstances, seeing that the government in the US does not operate historic military aircraft, unlike, say, in the UK.

It is an unfortunate case all around, and I certainly don't claim to have any judgements on intent, errors or whatever else of Mr Hendrickson. But some of the discussion?

The facts linked to in Chris' earlier post are evidently not effectively legally contestable. (Were they otherwise, which is all that counts, it would be a different debate.)

That makes them the only facts that count (as in 'are effective'.)

Anyone can argue anything they like about it - we know well enough the headlines of what happened and the consequences.

Arguing otherwise is just, finally, as pointless as claiming your team was robbed when they lost the game.
